Administration allowed to settle with businesses

Settlements with public authorities: On 6 September, a supplement to Rzeczpospolita daily published an article entitled Administracja będzie godzić się z kontrahentami by Jakub Janik, a legal counsel with SENDERO Tax & Legal. It deals with so-called “creditor pack” and suggests ways to effectively conclude disputes with public authorities. Jakub discusses a regulation expressly allowing authorities to settle with businesses. The authorities should look for the best way to resolve a dispute, including by striving to settle it if the effect appears better than the likely outcome of the dispute. Importantly, authorities must prepare settlement benefit analyses. This is kind of a legal framework for their strategies, one that can benefit businesses, including by helping them to define bargaining positions of both parties to the dispute.
