We are happy to let you know that our litigators executed an in-court settlement today in an interesting yet complex engineering case. The settlement concludes many months of work put in by our lawyers and client’s engineering staff. The case involved warranty claims our client had raised in connection with faulty flashing work on several hundred rooflights on a production building. The warranty provider did not have sufficient assets to do the necessary repairs.
Filing a formal claim has prompted the contractor (warranty provider) to enter into settlement discussions where we sought a practical solution to the problem The negotiations involved various technical tests and attempts to find non-destructive methods to remove the faulty film from several hundred glass panels on the roof. We have enabled a favourable settlement that provided for specific performance rather than damages, helping to avoid years of litigation. The repair work took several months and turned out to be successful. The client received a refund of the filing fee on its claim and the litigation was discontinued.
