We are pleased to let you know that the Court of Appeal in Poznań dismissed plaintiff’s appeal in a slotting fee case and, as a result, our client avoided having to pay nearly PLN 10 million.

The judgment is of particular importance for us as this sort of cases is among the most difficult ones we have faced in courtrooms. When we began out litigation journey in slotting cases a dozen or so years ago, courts were reluctant to rule for defendants and it was extremely difficult to secure a favourable judgment.

With time, consistent case building efforts and gradual wins before the Supreme Court and then before appellate courts, it has become possible to reverse that unfavourable line of authority.

The outcome we have been able to secure stands as a confirmation of that evolution and as proof that striving to defend your client’s interests is worthwhile even in the most demanding cases.

While there is still a cassation appeal available to the plaintiff, the court’s ratio allows us to be optimistic about the final outcome.
