First occupancy is a matter of interpretation

First occupancy: On 1 September, the Rzeczpospolita daily published an article entitled Pierwsze zasiedlenie to interpretacyjny problem by Adam Wnuk of SENDERO Tax & Legal. The article is about interpretation issues and discusses the need for the VAT Act to set out clear rules on the taxation of sale of developed land. The definition of first occupancy has been a hard nut to crack for a long time. This generates issues with right treatment of such transactions. A future judgement of CJEU will have a huge impact on further practice of the taxman and is likely to resolve concerns about the meaning of first occupancy.
