In this difficult litigation we represented an employer who refused to treat an event involving its employee as an accident at work. The dispute has come before the court after the employee filed a petition for review of the administrative decision that found in favour of the employer. Our team has successfully defended the client before both the trial and the appellate court.
The courts fully leaned to our case as we argued that the employee’s worsening pain while at work was due to her internal condition and as such does not meet the definition of an accident at work, even if the event was caused by use of force in accordance with occupational health and safety standards. Importantly, there can be no accident at work if there is no external cause.
