The purpose and measure of an easement appurtenant must be objective while the way its usefulness is appraised shall have no regard to who owns the dominant estate”, ruled the Supreme Court in its judgment handed on 15 April 2021 in case no. I CSKP 86/21 in which we represented  the defendant. This resolved a difficult dispute over whether easement appurtenant may be used to secure private interests of the owner of the dominant estate.
