We are pleased to inform you of another success that SENDERO Tax & Legal’s tax advisors have achieved. Following our petition for review of a decision of the Head of the Kraków Tax Chamber, we have managed to get a favourable judgement for our client from the Kraków Provincial Administrative Court in what was a precedential case. The Court gave positive consideration to our arguments that the tax liability became barred by the statute of limitations despite the fact that a final and non-appealable judgement had been set aside as result of extraordinary administrative court proceedings. Our success is all the greater since the background situation was incredibly complex and the law did not refer directly to the matters considered. It is also all the more satisfying as thanks to our support our client received a reimbursement of their overpaid tax with default interest totalling almost twice as much as the amount enforced by the tax authorities.
